Terms of service.

These terms govern your use of Penwell, an AI service that drafts and posts content to X (formerly Twitter) on your behalf. By creating an account or connecting your X account, you agree to these terms.

Your account

• You must be at least 18 years old.
• You must own or be authorized to operate the X account you connect. Operating someone else's account without their permission breaks both these terms and X's.
• You are responsible for activity under your account.

1. Who sells

Penwell is sold by Penwell, Cyprus. Contact: hello@penwell.io.

2. How posting works

Penwell drafts posts and replies in your voice. Posts go out through X’s own API. Replies go out from your own browser through the Penwell extension, after you approve each one. We do not post without your explicit approval, either via the dashboard or through a confirmed schedule you set.

3. Subscriptions and payment

Starter is $19 a month or $190 a year. Pro is $49, $99 or $199 a month, or $490, $990 or $1,990 a year. Prices include VAT where it applies. Billing renews monthly or yearly until you cancel. You can cancel at any time from settings; access continues through the end of the paid period.

There is no free trial, unless a friend invites you: then your first 30 days are free. Otherwise you’re charged when you pick a plan.

If prices change, we tell you in Penwell at least 30 days before your next renewal, and you can cancel first.

Founding members: the first 50 on Starter keep $19 a month ($190 a year) for as long as their plan never lapses, even if the price rises.

In your first 14 days you can cancel for a refund of what you haven’t used: credits used or days passed, whichever is more. After that, payments already made are not refunded. This doesn’t limit your legal rights.

Credits: each plan comes with a monthly amount that refills on the day you joined; unused credits don’t carry over. Top-ups are charged when bought and stay while you have a plan.

Invites: a friend you invite gets 30 days free. When they pay, you get a month of your plan free, as credit on your next bill.

Switching: moving up starts now; you pay the difference for the days left in your month or year and get the same share of the extra credits. Moving down starts at your next renewal. A founding member who moves up keeps the right to come back to Starter at $19, as long as their plan never lapses.

4. Your X account

Penwell never posts to your account without your approval of that post, or a schedule you set up yourself with an API key.

Connecting X is OAuth 2.0. We never receive your X password. Access and refresh tokens are encrypted at rest. You can disconnect at any time from Settings; we delete the tokens immediately.

5. What you can't do

• Use Penwell to post spam, harassment, hate speech, or content that breaks X's rules.
• Use Penwell to impersonate another person.
• Attempt to extract our underlying prompts, model weights, or training data.
• Resell or sublicense access without our permission.

6. AI-written content

• Penwell’s AI writes drafts for you. It’s told never to write buy or sell calls, but AI makes mistakes.
• AI can get facts and numbers wrong. Check every post before you approve it.
• You’re responsible for what you post. If you’re paid to promote something, say so.
• Posts about stocks you mark as owned get a line saying you own them. Keep that list up to date.
• Nothing Penwell shows or writes is investment advice.

Drafts are produced by AI based on your voice profile. You are responsible for what you approve and publish, including accuracy. We retain a reasonable license to the prompts, drafts, and feedback you provide so we can deliver and improve the service.

7. Termination

You can cancel your subscription from settings at any time. To have the account itself erased, email hello@penwell.io and we delete it and all your data within 30 days. We may suspend or terminate accounts that breach these terms, with notice when we reasonably can.

8. Disclaimers

Penwell is provided "as is". We don't warrant that the service will be error-free or that drafts will perform on X. We are not liable for content X removes or actions X takes against your account.

9. Liability cap

To the extent permitted by law, our total liability for any claim arising from your use of Penwell is capped at the amount you paid us in the 12 months before the claim.

10. Changes to these terms

We may update these terms. Material changes will be announced in Penwell at least 14 days before they take effect, and you can cancel before they apply.
